These Terms and Conditions govern the use of the website andreacrespiedition.com (the “Website”) as well as the contractual sales relationship between ShapeUp Studios S.r.l. (the “Seller”) and the Customer, relating to the pre-order and purchase of a limited-edition sculptural artwork.
The sale of the Artwork does not constitute a continuous e-commerce activity, but represents the final phase of economic enhancement of a single, specific artistic project.
The Artwork is produced in a limited, numbered, and non-repeatable edition, for a maximum total of 33 copies.
The Artwork is not available in stock and is produced exclusively on a made-to-order basis, following the Customer’s pre-order.
Each piece is individually produced using high-precision additive manufacturing and artisan finishing. Minor variations between pieces are an inherent characteristic of the artisanal process and shall not be considered defects.
The price of the Artwork is displayed on the Website at the time of purchase and is binding for the Customer.
The edition is divided into sequential “chapters” with progressive pricing. Any price increases apply only to orders placed after the price change.
The edition number is assigned chronologically based on the order confirmation time.
Orders are placed through the pre-order procedure available on the Website.
The sales contract is considered concluded upon successful payment confirmation.
By placing an order, the Customer acknowledges and accepts the made-to-order nature of the Artwork.
Estimated production time is up to 15 business days from payment confirmation.
Shipping times are not included in the production timeframe and depend on the destination.
Any delays caused by circumstances beyond the Seller’s control (including force majeure, supplier delays, or logistical issues) will be promptly communicated.
The Artwork is produced exclusively on commission, in a limited and numbered edition, and is not suitable for resale to third parties.
For this reason, and in accordance with applicable consumer protection laws, the right of withdrawal does not apply.
By completing the purchase, the Customer expressly acknowledges and accepts the final and non-revocable nature of the order.
The Seller guarantees replacement of the Artwork only in the event of accidental damage occurring during transportation.
Upon delivery, the Customer must inspect the packaging and the Artwork and report any damage within 48 hours of receipt, providing written notice and photographic evidence.
If the damage is confirmed, the Seller will arrange for the collection of the damaged Artwork and its replacement, at no additional cost to the Customer.
No returns or replacements are accepted for reasons other than transport-related damage.
For Customers qualifying as consumers under applicable law, the legal warranty of conformity applies.
Due to the limited-edition nature of the Artwork, replacement may only be possible within the limits of availability. Where replacement is not possible, the remedies provided by law shall apply.
The Artwork constitutes a work of authorship under applicable law, and all related intellectual property and copyright remain the exclusive property of the artist Andrea Crespi.
ShapeUp Studios S.r.l. operates pursuant to a license agreement authorizing the economic exploitation of the Artwork exclusively in relation to this specific limited edition.
The purchase of the Artwork transfers ownership of the physical object only and does not imply any assignment or license of reproduction, distribution, public communication, or economic exploitation rights, which remain reserved to the rights holder.
These Terms and Conditions are governed by Italian law.
For consumer Customers, the competent court shall be that of the Customer’s place of residence or domicile, where applicable.
For all other cases, jurisdiction shall lie with the court of the Seller’s registered office.
